We promise to process all orders promptly. You can help us by giving all
necessary information. To avoid delay, please complete your order form
accurately. Most seed-only orders go by First Class Mail; orders with supplies
or large quantities of seed go by United Parcel Service or by Postal Service.
For quickest service, phone in orders or fax them with your credit card number.

To order by mail using the order form, please print plainly. Give your complete
address, including street name and number. United Parcel Service cannot deliver
to a post office box. Please do not send cash. Make checks payable in U.S.
dollars to TOMATO GROWERS SUPPLY COMPANY.
Credit cards are acceptable -- Visa, Mastercard
and Discover only. Sorry, we do not fill C.O.D. orders. So that we may call you
in case of a problem, please include your telephone number in the space
provided.
Sales Tax: Florida customers must pay 6% sales tax on all items except seeds.
Shipping: We ship orders via First Class Mail or UPS. A handling charge of $5.25 is
charged for each order. Orders ship within a few days after we receive them
except in our busy season when it may take a little longer. We offer next day or
second day delivery at competitive rates upon request. Tomato Growers Supply
Company pays the postage anywhere in the continental U.S. on all items included
in this catalog. Call for the additional shipping costs to send supplies outside
the 48 states.
Notice to Buyer WARRANTY AND CONDITIONS OF SALE
Tomato Growers Supply Company warrants that the seed it sells conforms to the
label description, as required by federal and state seed laws. WE MAKE NO OTHER
WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, OR OTHERWISE. It is recognized that a mistake can be made in the
production, processing, or packaging of such seed. Moreover, seed is a living
product and its performance is affected by countless factors, many of which are
beyond the control of both the seedsman and the buyer. Accordingly, LIABILITY
FOR DAMAGES FOR ANY CAUSE, INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY AND
NEGLIGENCE, WITH RESPECT TO SEEDS PURCHASED FROM US IS LIMITED TO A REFUND OF
THE PURCHASE PRICE OF THE SEEDS. THIS REMEDY IS EXCLUSIVE. IN NO EVENT SHALL WE
BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF
PROFITS. We have based the prices of our seeds on this limited warranty and
limited liability, and our prices would be much higher if further liability
coverage were required. Our acceptance of a customer's order is expressly made
conditional on customer's assent to the terms and conditions provided herein.
Any changes or additions to these terms must be in writing and signed by an
officer of Tomato Growers Supply Company.
